RENTAL AGREEMENT
PLEASE READ CAREFULLY:
Purchasing the booking is the same as a legal signature of this agreement when renting equipment from Seaside Surf Company, LLC.
I accept for use the equipment listed on this form and accept full responsibility for the proper care and return of the equipment listed on this form. I have made no misrepresentation to the Provider of this equipment regarding this User's age, ability, or intent. I understand that the use in the sport for which this equipment was designed may involve a risk of life-threatening or bodily injury to all/any parts of this User's body. I hereby agree to freely and expressly assume and accept any and all such risks of life-threatening or bodily injury on the use of this equipment.
I understand that I will release the Provider of this equipment from any and all responsibility or liability for injuries or damages to the User of the equipment listed on this form, or for any other person that uses the equipment with or without my permission. I will not make any claim against or sue the Provider of this equipment for life-threatening or bodily injuries or damages relating to the use of this equipment in any manner for which I should know that it was not designed.
Unless I am a Parent renting this equipment for use by Minor, I agree not to allow any other person to use this equipment. However, it is expressly understood that such use by a Minor is without consent of the Provider, and the Parent allowing such use assumes all responsibility for allowing the Minor to use this equipment.
As a Parent User renting this equipment for the use by a Minor, User agrees to indemnity Provider against any claim, demand, losses, or damages arising out of the injury or property damage through the use of said equipment by said Minor. I have fully read and fully agree to accept the terms and conditions of this agreement, including the release of liability to Provider in the using of this equipment. This Agreement constitutes the entire agreement between the Provider and the User and no oral representations have been made which are not parts of this Agreement. The provider has not made any warranties, express or implied, and this equipment is accepted as is. I agree that as one who practices the sport for which this equipment was designed, I understand the basics of the use of this equipment. The Provider has made suggestions as to the geographic points of interest for the safest and most beneficial use of this equipment.
In the event of damage to equipment the User will pay a reasonable repair fee determined by the Provider. In the event of lost or stolen equipment the User will pay full retail cost to Provider.
